Understanding California’s Type 42 Liquor License

The Type 42 liquor license is specifically designated for bars and taverns. This license permits the sale of beer and wine for both on-site consumption and off-site sales. Notably, it does not grant permission for the sale of distilled spirits within the premises. In adherence to California law (BPC § 25663.5), minors are not permitted to enter or remain on the premises, with the exception of musicians under certain circumstances.

Unlike some other liquor license types, the Type 42 license does not mandate the provision of food services within the establishment. However, it is important to note that this license category is subject to Responsible Beverage Service (RBS) requirements. This means that both alcohol servers and managers of alcohol servers at Type 42-licensed establishments must obtain RBS certification, ensuring that they are well-trained in responsible alcohol service practices. This certification helps maintain the safety and integrity of alcohol service in these venues.

In summary, the Type 42 liquor license is tailored for bars and taverns in California. It permits the sale of beer and wine, while prohibiting the presence of distilled spirits on the premises. Minors are generally not allowed, except for certain circumstances involving musicians. Food service is not obligatory, but adherence to Responsible Beverage Service (RBS) requirements and RBS certification for alcohol servers and their managers is mandatory to ensure responsible and safe alcohol service in these establishments.

Definition and Scope: The Type 42 liquor license is issued by the California Department of Alcoholic Beverage Control (ABC) and is specifically designed for businesses that operate as Bars and Taverns. This license permits the sale of beer and wine for consumption on the premises where they are purchased. It does not authorize the sale of distilled spirits or hard liquor.

Eligibility: To obtain a Type 42 liquor license, applicants must meet certain criteria. The establishment must adhere to local zoning and land-use regulations.   A Conditional Use Permit may be required if the premises have never had a license in the past.   A formal ABC application must be file to obtain a Type 42 liquor license from the Alcoholic Beverage Control.

Application Process: The application process for a Type 42 liquor license can be quite intricate. It typically involves background checks, financial disclosure, and approval from local government authorities. Application processing time is approximately 60-90 days.  Liquor License Agents can assist with the application process – Schedule an appointment with a consultant today 1-800-799-9081 |  info@liquorlicenseagents.com

Restrictions and Obligations: Holders of Type 42 liquor licenses must abide by various rules and obligations. They are prohibited from selling alcoholic beverages to individuals under the legal drinking age, and they must ensure responsible alcohol service. Licensees must also maintain records of their alcohol purchases and sales, which can be subject to inspection by the ABC.

A Type 42 liquor license in California is a valuable asset for Bars and similar establishments looking to open their business without the expense of a full liquor license. It allows them to serve beer and wine without the requirement of serving meals. While the application process can be rigorous, the benefits of obtaining this license can be a worthwhile investment in the state’s vibrant hospitality industry.

Type 20 & 21 Liquor
License

Both Type 20 and Type 21 licenses are designated for the sale of alcohol for off-premises consumption. Minors are allowed on the premises of businesses that are issued this type of license. The Type 20 license is issued for the sale of packaged beer and wine, while the Type 21 is designated for the sale of general packaged alcohol, including spirits and liquor.

Type 41 & 47 Liquor
License

Probably some of the most common types of liquor licenses, the Type 41 and Type 47 licenses are specifically designated for businesses that primarily serve food. The California Department of Alcoholic Beverage Control states that, in order to be issued a Type 41 or Type 47 license, your facility must be a “bona fide eating place.” 51% of the total sales should come from food.

Type 48 Liquor
License

Type 48 licenses differ from Type 41 and Type 47 licenses as they are used in establishments that are not primarily eateries. Type 48 Licenses are typically issued for bars and nightclubs. The Type 48 license permits the holder to serve liquor until 2:00 AM. Unique to this license, the Type 48 allows closed containers of beer or wine to be sold for “off-premises” consumption.
