The California Department of Alcoholic Beverage Control states that, in order to be issued a Type 41 or Type 47 license, your facility must be a “bona fide eating place.” 51% of the total sales should come from food.

Type 48 licenses differ from Type 41 and Type 47 licenses as they are used in establishments that are not primarily eateries. Type 48 Licenses are typically issued for bars and nightclubs. The Type 48 license permits the holder to serve liquor until 2:00 AM. Unique to this license, the Type 48 allows closed containers of beer or wine to be sold for “off-premises” consumption.

But once acknowledged by the ABC, they will immediately send a notice to the location of your business to notify the local population of your intention to sell liquor in the area. If there are no complaints about your application, the ABC will then move forward to examining all the information listed on your application. It is also important to remember that there are licenses that may require no less than half of your income to generate solely from food sales. Other licenses are issued solely for selling containers that are to be consumed only off the premises. There will be times, however, that the ABC may not grant you a Merced Liquor License. This is because your county has either reached their quota of issued licenses or they have exceeded it.
